The protective intervention phase begins when, at the conclusion of an investigation, the practitioner:
- Has determined that the case is substantiated, and a protection application (PA) is issued, or
- Determines that the case is substantiated and the family agrees to work with child protection on a voluntary basis to address the protective concerns.
Following substantiation, a case plan is to be prepared for each child, endorsed, and provided to the family within 21 days.
A case remains in the protective intervention phase until one of the following occurs:
- The Children's Court makes a protection order. The case then proceeds to the protection order phase.
- The Children's Court decides not to make a protection order either because the application is not found proven or the application is withdrawn. The case then proceeds to closure phase.
- In the absence of a protection application, the protective concerns have been sufficiently addressed and no further child protection involvement is required.
For the purposes of moving a case from protective intervention phase to either protection order or closure phase, the outcome codes recorded on the client information system (CRIS) are as follows:
- A case proceeding from protection intervention to closure is recorded as: No further action required.
This will move the case to closure phase in CRIS.
- A case proceeding from protective intervention to protection order will be automatically recorded in CRIS as: Further action required.
The system will move the case to protection order phase in CRIS and is an automated outcome following the making of a protection order.
